CLE, MCLE and CONTINUING LEGAL EDUCATION FOR ARIZONA, CALIFORNIA, FLORIDA AND NEW YORK ATTORNEYS
Mandatory continuing legal education requirements have been adopted by the majority of US jurisdictions. This article briefly discusses the mandatory continuing legal education requirements of the states of Arizona, California, Colorado, Florida and New York, including a summary of the respective CLE / MCLE requirements in those particular states.
Not discussed in this article are any special requirements for newly admitted attorneys as regards particular MCLE , CLE or other continuing legal education requirements imposed on new lawyers in the preceding jurisdictions. Arizona adopted it's MCLE requirements for Arizona lawyers effective 1989, and requires 15 hours of continuing legal education per year, including 3 hours of legal ethics. Interestingly, Arizona does not approve or accredit any particular CLE or MCLE providers, instead specifying the nature of approved programs. For details on the Arizona MCLE rules, Click Here.
California initiated it's mandatory continuing legal education program in 1992, chosing to denominate it as "minimum" rather than "mandatory" continuing legal education. California has divided it's lawyers into three "compliance groups" based on the first letter of their last name, and requires it's attorneys to complete a total of 25 hours of MCLE in each 3-year compliance period. Required California MCLE subjects required in each 3 year period include 4 hours of legal ethics, one hour on substance abuse, and 1 hour of eliminating bias in the legal profession. Colorado adopted it's mandatory continuing legal education requirements effective 1979, and imposes a total 45 hour reqirement over a three year period. Subjects required by the Colorado MCLE rules include 7 hours of legal ethics. Colorado approves MCLE providers, and allows reciprocity for providers in other mandatory CLE jurisdictions. In addition, Colorado also approves "home study MCLE programs" which can be completed entirely by correspondence and other non-attendance methods. Florida initiated it's continuing legal education (CLE) program in 1988. Florida's Continuing Legal Education regulations require a total of 30 hours over a 3 year period, inlcuding 5 hours of legal ethics / professionalism and requirements for substance abuse or mental illness awareness. New York instituted it's CLE program in 1998. The New York continuing legal education program requires a total of 24 credits (hours) in a biennial reporting cycle based on the New York attorney's birthdate. Specific New York CLE requirements include at least 4 credits in legal ethics/professionalism; however newly admitted New York lawyers have different requirements.
